The SEC released an official interpretive document on March 17, 2026, and added a batch of tokens to its digital commodities examples list. Digital commodities have basically evaded securities law regulation. Here's the complete list:



The first tier consists of 16 tokens that are consistently classified as digital commodities:
$BTC (Bitcoin)、 $ETH (Ethereum)、 $XRP (Ripple)、 $SOL (Solana)、
$ADA (Cardano)、 $DOGE (Dogecoin)、 $SHIB (Shiba Inu)、 $LINK (Chainlink)、
$AVAX (Avalanche)、 $APT ( Aptos)、 $HBAR ( Hedera )、 $LTC (Litecoin)、
$DOT (Polkadot)、 $XLM (Stellar)、 $XTZ (Tezos)、 $BCH (Bitcoin Cash)

Additionally, $ALGO ( Algorand )and $LBC (LBRY Credits)were also singled out by the SEC as digital commodities, which came as a pleasant surprise.

The most controversial case here is $XRP. The SEC listed $XRP as a digital commodities example in 2026, but the court still determined that certain sales practices of XRP fall under securities law. As a result, the SEC added some emphasis to clarify that while the token itself is not a security, this doesn't mean that all issuances, sales, and packaging methods of that token are exempt from securities law—somewhat like preparing a special dish just for this particular criticism.

The secondary market positioning has essentially been finalized. Subsequent regulatory clarity will likely become more explicit. Following the US approach will at least get you through to the next cycle. Who knows—maybe the next altseason will be a digital commodities season.
