隨著虛幣投資熱度升溫，「幣圈老師」與帶單群組盛行，立法院財委會立委關注其是否涉及影響市場價格與誤導投資人。金管會主委彭金隆於 3 月 23 日答詢時表示，將透過《金融消費者保護法》授權子法納管相關行為，建立有序市場。
現行規範不足，帶單行為實質具投資建議性質
立委李彥秀指出，現行規範雖已禁止意圖影響價格的操作，但市場上仍充斥教學喊單、帶進帶出等行為，實質已具投資建議性質，要求金管會明確說明未來是否將虛擬資產分析與顧問行為納入管理範疇。
彭金隆回應，類似行為在傳統金融市場已有相應規範，例如網紅推廣金融商品也受一定限制。未來可在《金融消費者保護法》授權子法中，針對金融服務業透過 KOL（關鍵意見領袖）進行廣告、招攬與促銷活動等行為加以規範。
民眾黨版本：要求 VASP 揭露資訊、禁止誤導性促銷
在立法方向上，民眾黨版本已明確納管「關鍵意見領袖」，涵蓋三項重點：
要求虛擬資產服務商（VASP）在廣告與行銷中揭露公司名稱及許可資訊
禁止虛偽或誤導性促銷
規範 KOL 須具備一定資格條件
實務操作有難度，業界採自律機制
金融業者坦言，實務上要求 KOL 具備特定資格條件難度極高。目前投信投顧公會已建立投信業者與網紅合作的自律機制，採取雙方簽訂合作契約、納入業者內控制度，並定期檢視網紅行銷合規性的方式運作。
此次討論是台灣虛擬資產服務法草案整體立法進程的一部分。隨著 VASP 登記制度逐步落地，KOL 帶單行為的監管補位，將成為台灣加密貨幣監理框架趨於完整的關鍵一環。
