Hoskinson在讨论《数字资产市场清晰法案》（Clarity Act）时指出，规则草案要求寻求数字商品地位的代币项目必须向SEC提交申请，并接受至少60天的审查，SEC可在必要时暂停或要求补充信息，延长审批周期。草案强调，项目需证明其网络足够去中心化，单一实体不得控制超过20%的代币。Hoskinson认为，尽管XRP此前已通过联邦法院裁决明确非证券身份，但若按照新标准，其可能被认定为证券。
